Master Terms of Service
Effective Date: January 1, 2026
By accessing, purchasing, or using any WorkTruth website content, diagnostics, advisory services, reports, or sessions (collectively, the “Services”), you agree to be bound by these Master Terms of Service (“Terms”). If you do not agree, do not use the Services.
These Terms incorporate by reference the WorkTruth Privacy Policy and WorkTruth Refund Policy, each of which forms part of this agreement.

Nature of Services
WorkTruth provides structured diagnostic, educational, and advisory insights related to workplace experiences, organizational dynamics, and employment situations.
WorkTruth does not provide:
- Legal advice
- Medical or mental health services
- Therapy, counseling, or clinical diagnoses
- Representation in legal, employment, or regulatory matters
Nothing provided by WorkTruth is a substitute for advice from a licensed attorney, therapist, or medical professional.
Certain anonymized insights derived from services may also contribute to WorkTruth’s independent research initiative, as further described below.

WorkTruth Project Participation & Research Use

Voluntary Research Participation
WorkTruth operates an independent research initiative known as the WorkTruth Project, which analyzes aggregated, anonymized workplace experiences to identify patterns and trends. Participation in the WorkTruth Project is entirely voluntary and not required to purchase or receive any WorkTruth services.
Participants may elect to contribute information for research purposes at no cost. Participation does not create a client relationship, does not constitute professional advice, and does not include individualized analysis or feedback.

Relationship Between Services and Research
Clients who purchase WorkTruth Consulting services (including Insight Snapshot, Diagnostic, or Diagnostic + Strategy Session) may be invited to allow their submitted information to be included in the WorkTruth Project dataset.
Consent to research inclusion is separate from the purchase of services and is requested explicitly. Declining participation does not affect the scope, quality, pricing, or delivery of services.
Fees paid for WorkTruth Consulting services reflect analysis and insight provided to the individual client, not the value of any data contributed for research purposes.

No Compensation for Research Participation
Participation in the WorkTruth Project is not compensated. No discounts, refunds, credits, or fee reductions are offered in exchange for research participation. WorkTruth does not buy, sell, or trade individual participant data. Research participation is intended solely to support aggregated analysis and publication of anonymized insights.

Use of Research Data
Information contributed to the WorkTruth Project may be analyzed, aggregated, and synthesized for purposes including, but not limited to:
- Research publications
- Industry reports
- Presentations
- Educational materials
- Advisory and thought leadership content
All research outputs are presented in aggregated and anonymized form. No identifying details (including names, employers, or specific facts that could reasonably identify an individual or organization) are published.

No Impact on Upsell or Service Credits
Fees paid for WorkTruth Consulting services may be credited toward higher-tier services as described at the time of purchase. Research participation does not affect eligibility for service upgrades, credits, or pricing. Credits apply only to fees paid for services rendered and are not influenced by participation or non-participation in research activities.

Right to Withdraw Consent
Participants may withdraw consent for future inclusion in the WorkTruth Project at any time by submitting a written request to WorkTruth. Withdrawal of research consent does not affect services already delivered and does not require deletion of anonymized data that has already been aggregated or incorporated into published or in-progress research.

Ethical Use and Boundaries
WorkTruth is committed to ethical research practices and responsible use of participant information. The WorkTruth Project is designed to identify systemic patterns not to evaluate individual employers, adjudicate disputes, or provide legal conclusions.
WorkTruth does not provide legal advice, does not serve as a representative or advocate, and does not use research participation for marketing or solicitation purposes without separate, explicit consent.

No Employment, Agency, or Fiduciary Relationship
Your use of WorkTruth does not create an employment relationship, an agency relationship, a fiduciary duty, or a professional-client relationship beyond the limited advisory scope described herein.
WorkTruth does not act on your behalf, advocate for you, negotiate for you, or make decisions for you.

User Responsibilities
By using WorkTruth Services, you agree that:
- Information you provide is accurate to the best of your knowledge
- You are solely responsible for all decisions, actions, and outcomes arising from your use of the Services
- Employment outcomes vary and cannot be guaranteed
You acknowledge that any decisions or actions taken by you or others based in whole or in part on WorkTruth insights remain your responsibility.

Intellectual Property; Use Rights; Restrictions; Aggregated Data

Ownership of WorkTruth Intellectual Property
All right, title, and interest in and to all intellectual property owned, developed, or used by WorkTruth prior to or independent of the Services (“WorkTruth IP”) remain exclusively with WorkTruth. WorkTruth IP includes, without limitation, all frameworks, methodologies, diagnostic models, scoring logic, analytical approaches, taxonomies, workflows, templates, questionnaires, prompts, tools, report formats, educational materials, and any improvements or derivatives thereof.
Except for the limited license expressly granted below, nothing in these Terms transfers or assigns any intellectual property rights to you.

Limited License to Use Deliverables
Subject to your compliance with these Terms, WorkTruth grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the reports, summaries, analyses, and other outputs provided to you (“Deliverables”) solely for your personal, non-commercial, internal use in connection with your own workplace situation or the specific Service purchased.
Fees paid are for access to Services and Deliverables and do not convey ownership of any WorkTruth IP.

Restrictions
You may not, and may not permit any third party to:
- Copy, reproduce, distribute, publish, sell, sublicense, or publicly display any Deliverables or WorkTruth IP
- Use Deliverables or WorkTruth IP to create derivative works, competing services, internal programs, or commercial products
- Reverse engineer, deconstruct, benchmark, or otherwise attempt to discover WorkTruth’s underlying methodologies, scoring logic, decision criteria, or analytical processes
- Use Deliverables for training, organizational rollout, or advisory services to others without WorkTruth’s prior written consent

Confidentiality of Methods
WorkTruth’s non-public methods, analytical logic, evaluation criteria, and diagnostic processes constitute confidential and proprietary information. Your confidentiality obligations extend to these methods, not solely to personal or diagnostic data.

Client Materials
You retain ownership of documents, information, and materials you provide to WorkTruth (“Client Materials”). You grant WorkTruth a limited right to use Client Materials solely to perform the Services and, where consent is provided, for research purposes as described in these Terms and the WorkTruth Project.

Aggregated and De-Identified Data; Research Use
WorkTruth may analyze, aggregate, de-identify, and synthesize information derived from Client Materials and Services to identify patterns, trends, and insights. Such aggregated and de-identified information may be used for research, benchmarking, quality improvement, and publication, including through the WorkTruth Project, provided no individual or organization is reasonably identifiable.
Aggregated and de-identified data is not considered confidential information and may be retained and used indefinitely.

Feedback
Any feedback, suggestions, or ideas you provide regarding the Services or Deliverables may be used by WorkTruth for any purpose without restriction or compensation.

Survival
This Section survives termination or completion of the Services.

Confidentiality & Data Use
WorkTruth treats individual diagnostic data as confidential and does not sell personal data or share identifiable information with employers.
Confidentiality does not extend to:
- Aggregated or anonymized insights
- De-identified patterns or methodologies
Nothing in these Terms creates attorney-client privilege or any other legally protected privilege.
Data handling practices are governed by the WorkTruth Privacy Policy, incorporated by reference.

Payments & Refunds
Fees, payment terms, and refund eligibility are governed by the WorkTruth Refund Policy, incorporated by reference.
Because Services involve time, analysis, and intellectual labor, refunds are limited and subject to the conditions stated in the Refund Policy.

Chargebacks
Initiating a chargeback without first contacting WorkTruth constitutes a violation of these Terms and may result in immediate service termination.
WorkTruth reserves the right to dispute chargebacks using documentation of service delivery, acceptance, and acknowledgment of these Terms.

Limitation of Liability
To the fullest extent permitted by law, WorkTruth shall not be liable for employment decisions made by you or others, financial, emotional, or reputational outcomes, or any losses arising from reliance on diagnostic insights.
This includes decisions or actions taken by you or others based in whole or in part on WorkTruth insights, interpretations, or materials.
WorkTruth’s total liability, if any, shall not exceed the amount paid for the specific Service giving rise to the claim.

Termination of Services
WorkTruth reserves the right to refuse or terminate Services if content provided is abusive, fraudulent, or misleading; Services are used in bad faith; or these Terms or boundaries are violated.
Termination does not entitle you to a refund except as expressly stated in the Refund Policy.

Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Texas. The parties consent to personal jurisdiction and venue therein.

Modifications
WorkTruth may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
